Your new-build garden is waterlogged. Here's who's responsible.
Why gardens on new estates hold water, how to tell compaction from a drainage fault, and the order to escalate it in — developer first, warranty provider second.
Worth doing yourself
Both tests, and the evidence pack. A spade, a bucket, a tape and a phone camera are enough to prove whether your garden is waterlogged because of the weather or because the ground was compacted flat by plant and topped with 50mm of soil.
Not worth doing yourself
The remedy. Breaking a machine-made pan across a whole garden, installing land drainage and re-grading levels is a mini-digger job. Do the tests first anyway — if the house is under warranty, the evidence matters more than the fix.

Aylesbury is ringed by large new developments — Berryfields, Kingsbrook, Buckingham Park, Hampden Fields, Orchard Green. The gardens on all of them share a problem, and it is usually the same problem: the ground was driven over for eighteen months and then covered up.
This post is about working out what you've actually got, who you take it to, and what a real fix involves. Do the diagnosis before you spend anything, because the first person you should be talking to is not a landscaper.
What happens to garden ground during construction
A plot is stripped of topsoil before the foundations go in. What's left is subsoil, and for the length of the build it carries tracked excavators, dumpers, telehandlers, scaffold and stacked materials — often in the wet.
That traffic compacts the subsoil into a dense layer, a pan, with almost no pore space left in it. Water cannot pass through a pan at any useful rate. At the end of the job a thin layer of topsoil goes back over the top, turf goes on that, and the garden looks finished.
So when it rains, water soaks through the shallow topsoil in minutes, reaches the pan, and stops. It has nowhere to go but sideways and up. That is why the puddle appears in the same place every time and stays for days.
Telling compaction apart from a drainage fault
They need different fixes, and they are easy to tell apart if you look properly. Wait until 24 hours after real rain, then check.
- Push a screwdriver or a spade into the lawn. If it goes in 75–150mm and then hits something that feels like tarmac, that's a pan. Compaction.
- Dig a test hole 300mm deep and fill it with water. If it is still full hours later, the ground is not draining — compaction, clay, or both.
- Water standing in one defined spot, lower than the rest, with the surrounding lawn firm underfoot: a levels problem. The garden is falling to the wrong place.
- Water appearing near a downpipe, a gully or a manhole, or a wet patch that never dries even without rain: that is a drainage fault, not compaction, and it belongs to the developer straight away.
- Grass thin, yellowing and rooting only in the top 50mm: shallow topsoil over a pan. Lift a corner of turf and measure the topsoil depth while you're there.
The escalation order: developer first, warranty provider second
Do it in this order, and do it in writing. Going to the warranty provider before the developer has had a fair chance to respond usually gets you sent back.
First, report it to the developer's customer care team in writing, with photographs and dates. Ask specifically what topsoil depth was laid and whether the subsoil was ripped or otherwise decompacted before topsoiling. Keep every reply.
Second, if the developer will not resolve it, go to the warranty provider — for most new homes in this area that is NHBC. What is and isn't covered varies by policy, by the age of the home and by the nature of the defect, so read your own policy documents and use the provider's own resolution route rather than taking anyone's word for what is covered. We are not going to tell you what your warranty says.
What to document, starting today
Evidence decides these cases. It costs nothing and it takes five minutes at a time.
- Dated photographs of standing water, taken from the same spot each time so the images compare directly. Get a fixed reference in shot — a fence post, a step, the corner of the patio.
- How long the water stays. "Standing water still present 48 hours after rain, no rain since" is worth more than any adjective.
- A photograph of the test hole with a tape in it, showing topsoil depth and where the pan starts.
- A note of the rainfall date, and a photograph of the same area in dry weather showing cracked or bare ground.
- Every piece of correspondence with customer care, with dates.
What a proper fix involves
If the fix falls to you in the end, it is groundworks, not gardening. The order matters.
Break the pan. Subsoil is ripped or dug through so water can move down again — not rotavated, which chops the top and can glaze the layer underneath. Then get the levels right so the garden falls somewhere deliberate rather than to the middle.
Put in drainage where the ground still cannot cope: a land drain in stone running to a soakaway, or to an appropriate outfall. On Gault Clay a soakaway has to be sized and sited for ground that infiltrates slowly — which is most of this area.
Then topsoil at a real depth — 100–150mm for lawn, more for planting beds — and only then turf. Re-turfing on top of the same compaction is the most common thing that happens on these estates, and it fails again within a season because nothing about the reason for the water changed.
Two tests that produce evidence, not opinions
A developer will not act on "the garden is always wet". They will act on measurements with dates on them. Both of these take an afternoon and cost nothing.
Step 1
The spade test
Pick a spot in the worst area and drive a spade in with your full weight. On normal ground it goes in to the shoulder of the blade with steady effort. On a machine-made pan it stops dead at 100–150mm as though you have hit a floor, and the jar goes up your arms. Lever out what you can and look at the face of the hole: a pan shows as a dense, grey-brown, almost polished band, often with a smeared, shiny surface where a tracked machine or a bucket has sealed the clay. Topsoil above it will be thin — measure it. On plenty of new plots it is 50–100mm over a sealed subsoil.
Step 2
The percolation test
Dig a hole roughly 300mm square and 300mm deep. Fill it to the top with water and let it drain away completely — this wets up the sides so you are measuring the ground, not the dry crust. Fill it a second time, then time how long that second fill takes to empty.
Step 3
Read the second drain
Gone within an hour or two: the ground drains, and your problem is levels or a low spot, not soil. Four to twelve hours: slow, typical of clay, workable with improvement and grading. Still holding water the next morning: that is not a soil that will grow a lawn. Something is sealed, and no amount of topsoil dressing on top will change it.
Step 4
Repeat it away from the problem
Do a second hole in a part of the plot that behaves — near a boundary, or in a bed that was never trafficked. If that one drains in an hour and the middle of the lawn holds overnight, you have shown that the ground is not uniformly bad. It was made bad, in the area the machines worked.
Step 5
Document it so it counts
Every photograph wants a date and something for scale in shot — a spade, a folding rule, a tape held against the hole. Photograph the topsoil depth against the tape, the face of the pan, both percolation holes at fill and at each check, and the standing water on the lawn. Write down the date, the rainfall in the previous 24 hours, how long water has been standing, and the times for each drain test. Keep it as one dated file.

Allow an afternoon for the digging and filling, plus checks the same evening and the next morning.
Check services
Before you put a spade or a bar in the ground
Water, gas, electricity and telecoms runs from the house often sit shallower than people expect, particularly around new estates and anywhere a garage or extension has been added later. Find the service entry points, work out where the runs are likely to head, and dig the first spit by hand. Never swing a mattock or drop a breaker into ground you haven't proved.

Get the ground assessed before you re-turf anything
If you've done the screwdriver test and hit a pan, the useful next step is someone opening a trial hole and telling you what depth of topsoil you've got and what's under it. That's a groundworks visit, and it tells you whether you're arguing with a developer or booking a job.
